Privacy Notice of the Berlinger Group

1 Purpose

1.1    The operator of the website www.berlinger.com (hereinafter "website") is Berlinger & Co. AG and Berlinger Special AG (hereinafter referred to as "Berlinger"). Privacy is important to Berlinger and Berlinger adheres to the applicable data protection laws and regulations.
1.2    This Privacy Notice shows Berlinger's handling of personal data and in particular explains which personal data of the visitor to the website (hereinafter referred to as "User") are processed by Berlinger and for what purposes these data are processed. It also describes how collected personal data can be checked, corrected or deleted.
1.3    This Privacy Notice does not extend to any external links leading to offers of third parties. The data protection regulations of the respective provider apply to these offers.


2 Collection of Personal Data

Berlinger respects the privacy of the User and will not collect any personal data (such as name, address, e-mail address) unless they are collected:

  • voluntarily provided and agreed by the User, for example company, first name, surname, address, telephone number and e-mail address when filling in the contact form; company, first name, surname and e-mail address when subscribing to the newsletter; or first name, last name, country, job title, company name and work e-mail address for download of a whitepaper;
  • or automatically collected by cookies.

2.1    Data collection at Berlinger events:
Berlinger processes personal data about participants in events organised by Berlinger including meetings, conferences, learning sessions and webinars. Berlinger may use various applications and online platforms to manage event registration processes. Please take note of their own privacy notices and read them carefully when you provide your personal data for the purposes of event participation.
Berlinger processes the following categories of personal data (to the extent they apply a specific event):

  • Name
  • Job title
  • Work Email address
  • Company Name
  • Country
  • Telephone or fax numbers


Berlinger may take photographs and audio or video recordings in public areas of the Berlinger events. Following the event, recordings may be further edited before they are published or distributed for marketing purposes.

2.2    Data collection over social media sites and interaction with our social media tools:

Social media sites

Berlinger uses various social media platforms for recruitment, marketing and business development purposes. We use social media to advertise recruitment opportunities with Berlinger and to promote products, services and brand.

Please note that while Berlinger is responsible for the content it publishes using social media platforms, Berlinger will not be responsible for the management and administration of any social media platforms. You should always familiarize yourself and read carefully any legal and privacy terms imposed by these social media platforms. If you have any questions on how the social media platform uses your data, you should contact the platform provider directly.

In some circumstances, Berlinger may obtain aggregated data from these social media platform providers, e.g., number of “likes” in response to Berlinger published content and posts, number of visitors who engage with our posts or information on links clicked and downloaded content.

Social media plugins

Social media plugins are also implemented on our website e.g., specific button which enables the site to establish a direct connection with the relevant social media platform server. As a result of such a direct connection, the social media provider will be informed of the relevant page on our site which triggered such link. If you wish to prevent such sharing, you should review your settings within your social media accounts prior to visiting our website as Berlinger has no influence on how the data is collected using social media plugins.

  • LinkedIn Lead Gen Forms
    Berlinger uses LinkedIn Lead Gen Forms for Berlinger sponsored content, and sponsored LinkedIn InMails for recruitment, business development and marketing campaigns. Once LinkedIn members click on Berlinger advertisement, they will see a form that is pre-filled with information from their LinkedIn profile, such as their name, contact information, company name, seniority, job title and location.     Berlinger uses LinkedIn Sales Navigator, which allows berlinger to target the right leads, understand key insights, and engage with personalised outreach. 3    Use of Personal Data

3.1    Data transmitted by the User to Berlinger may be used by Berlinger as follows:

  • For the fulfilment of contractual obligations;
  • Answer your inquiry when you contact us via the contact form;
  • Newsletter dispatch, if you have registered for the newsletter;
  • Whitepaper dispatch, if you have requested access;
  • For own marketing purposes, especially to better understand the needs of the Users and to improve the services of Berlinger;
  • To do business with the User. For this purpose, Berlinger may also send the data transmitted to it by the User to sales and cooperation partners of Berlinger at home and abroad. Further people do not receive any knowledge of the personal data.


3.2    Access to personal data is limited to those employees and sales and cooperation partners who require access to this data. The people and companies concerned are bound to secrecy and to comply with the applicable data protection laws. Berlinger will not sell or otherwise market personal data to third parties.

4    Cookies

4.1    When the User visits the website, information may automatically be stored on his computer. This takes the form of "cookies" or a similar file that helps Berlinger in various ways, for example to learn about the preferences of website visitors and to improve the website.
4.2    When the User visits the website for the first time, he decides which information is allowed to be collected.

5    Web Analytics

5.1    Berlinger uses the following web analysis services of third providers for the evaluation of the use of the website, to which personal data can also be transferred in the context of the use of these services. 

5.2    Google Analytics is a web analysis service of Google Inc. "("Google"). Google Analytics uses "cookies", which are text files placed on the User's computer, to help the website analyze how Users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating User use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. Under no circumstances will Google associate the IP address of the Users with other Google data. Users may refuse the use of cookies by selecting the appropriate settings on their browser, however, Berlinger points out to Users that in this case not all features of the Berlinger platform may be fully functional. By using the Berlinger platform, Users consent to the processing of data about them by Google in the manner and for the purposes set out above.

5.3    LinkedIn (Insight Tag). We use conversion tracking with LinkedIn Insights Tag, a tool from LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland on our website. For this purpose, the LinkedIn Insight Tag is integrated on our website and a cookie is placed on your device by LinkedIn. In this way, LinkedIn is informed that you have visited our website, and your IP address is also collected. Timestamps and events such as page views are saved. This enables us to statistically evaluate the use of our website in order to continuously optimize it and, for example, to get insights into the performance of a LinkedIn ad or the interaction on LinkedIn that brought you to our website. With this, we can better control the display of our advertising.

6    Data Security

6.1    Berlinger provides security measures to prevent the loss, misuse or alteration of information and personal data.
6.2    We use the most common SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. Usually this is a 256 bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form is indicated by the closed display of the key or lock symbol in the lower status bar of your browser. The User is aware that transmissions on the Internet are not secure. Once Berlinger has received the transmitted information, it backs it up appropriately in its systems.
6.3    We use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or unauthorised access by third parties. Our security measures are continuously improved and updated in line with technological developments.
6.4    We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on our websites. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). reCAPTCHA is used to check whether the data entered on our website (such as on a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the visitor has been on the website, or mouse movements made by the user). The data collected during the analysis will be forwarded to Google. The reCAPTCHA analyses take place completely in the background. Website visitors are not advised that such an analysis is taking place.
The website operator has a legitimate interest in protecting its site from abusive automated crawling and spam. 7    Third Party Offers

The website includes web shops operated by independent partner companies. Depending on the desired place of delivery for the goods, Users click on the relevant link to go directly to the web shop of the relevant provider. The collection of data by the operator of the web shop is stated in its data protection declaration and is not our responsibility. 

8    User's Rights

8.1    The User may at any time request Berlinger to send him a copy of the personal data which concern him or to inform him about their use.
